VISIT FLORIDA Vacation Contest
OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
Eligibility. Subject to the additional restrictions below, the WSB-TV Montlick & Associates Deserving Military Family Contest (the "Contest") is open to residents of the state of Georgia who are 18 years or older at the time of entry. Employees of WSB-TV, Montlick & Associates, P.C (d/b/a Montlick & Associates, Attorneys at Law – hereinafter referred to as Montlick and Associates), VISIT FLORIDA, and each of its respective affiliated companies, and advertising and promotional agencies, and the immediate family members of, and any persons domiciled with, any such employees, are not eligible to enter or to win. The term "immediate family members" includes spouses, parents, grandparents, siblings, children, and grandchildren.
For the purposes of this Contest, WSB-TV and Montlick & Associates, Attorneys are referred to as “Sponsors” in the official rules.
How To Enter. The Contest will begin at 9:00 a.m. on May 28, 2012 and end at 5:00 p.m. on July 13, 2012 (the "Contest Period"). There are two (2) steps necessary to enter the Contest.
Step 1: Complete an Official Entry Form available at wsbtv.com/contests.
Step 2: Attach at least one (1) photo of the Military person you are nominating with a brief essay of no more than three hundred (300) words in length explaining why the Family pictured in the photo is the Most Deserving Military Family and should be chosen for the Grand Prize or secondary prizes.
All entries must be received by June 13, 2012. All entries must have photographs and essays that are the original work of a Contestant. Entrants may nominate any member person or family they feel worthy. Photo uploads must be in gif or jpg format. Your essay and photo entry must be truthful and accurate, and your essay entry must reflect your honest opinions, beliefs, and/or personal experiences. Do not copy the work of others. Maximum one (1) entry per person and per household. For purposes of these Official Rules, a "household" includes all people who share the same residence for at least three (3) months a year, regardless of familial relationships.
Sponsors will not be responsible for incomplete, lost, late, misdirected or illegible entries. Any questions regarding the number of entries submitted shall be determined by Sponsors in its sole discretion. All entries become the property of Sponsors and none will be returned. The use of multiple identities and/or accounts is prohibited, and any attempt to obtain more than the stated number of entries will void that participant’s entries and may result in participant’s disqualification.
Sponsors will not be responsible for incomplete, lost, late, or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsors. In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the ISP account from which they were sent. For these purposes, an ISP account holder shall mean the natural person assigned to such ISP account by the Internet access provider, online service provider or other organization responsible for assigning ISP addresses for the domain associated with such ISP account. Any questions regarding the number of entries or the owner of an ISP account shall be determined by Sponsors in its sole discretion, and Sponsors reserve the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Contest.
Contestants acknowledge and agree that Sponsors shall have the right to edit, adapt, modify, reproduce, publish, promote, or otherwise display or use entries in any way it sees fit without limitation or compensation to entrants.
Entry Restrictions. Your entry (1) cannot depict trademarked apparel; (2) must be suitable for a general audience; (3) cannot contain any nudity, sexually explicit, disparaging, libelous or other inappropriate content (all as determined in the sole discretion of Sponsor); (4) cannot contain any commercial content that promotes any product(s) or service(s) other than Sponsor; (5) cannot contain any trademarks, copyrighted works or other intellectual property (other than works and intellectual property that you own, or for which you have obtained royalty-free rights for Sponsor to use in connection with this Contest (collectively, “Authorized Assets”). Any elements appearing in your entry must be entirely original, created by you, be in the public domain, or be an Authorized Asset. Use of any materials that are not original to you, not in the public domain, or that are not an Authorized Asset may result in disqualification. Sponsor reserves the right to disqualify any entry that violates the foregoing restrictions, as determined by Sponsor in its sole discretion.
Winner Selection. A panel of judges experienced in television production will be selected by Sponsors and will judge all eligible entries. Judges will select the top 5 entries. On or about June 14, 2012 the (5) five finalists will be selected and be notified.
Each selected finalist will be required to submit a video depicting their story and why they should be chosen as the Most Deserving Family. Videos may not be longer than 1 minute and be in a common video format that can be emailed. Videos must conform to the Entry Restrictions described above. Video must be submitted by email to WSB-TV on or before June 26, 2012. Video must be of quality to post on the web, or video will be disqualified.
Sponsors reserve the right in its sole discretion to the edit the Finalist's entries/videos and post only the photographs, essays and/or videos that Sponsors believe most clearly depicts the Contestant's family and reason for winning the Most Deserving Family Contest.
wsbtv.com website visitors will vote for the Finalists that they believe is the most Deserving Military Family between June 27 and July 13, 2012. One (1) Grand Prize Winner will be selected based on the largest number of online votes received on or about July 13, 2012. In the event of a tie in online votes, the Contest Judges will reevaluate the tied entries based on the Criteria to select one (1) Grand Prize Winner. The remaining 4 entries will be declared secondary winners.
Prizes and Odds.
One (1) Grand Prize Winner will receive a trip for 4
courtesy of Montlick and Associates, Visit Florida, and its partners, including:
- Round trip air transportation for 4 from Atlanta to Orlando
- Four (4) nights' accommodations at Coco Key Resort and Water Park
- Disney Park Hopper passes for 2 days for four (4) people.
- Car Rental 5 days (including gas allowance)
Approximate Retail Value for the entire grand prize is $3,500
Four (4) Secondary Prize winners will each receive:

Approximate Retail Value for each secondary prize package is $700
Odds of winning are based on the number of eligible entries received by the contest end date.
Terms and Conditions for All Prizes. All expenses and incidental travel costs not expressly stated in the prize package description(s) above, including costs of meals, parking, ground transportation, gratuities, transportation to and from airport, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes, and all other expenses not specified above, are the sole responsibility of the winner. The prize may be subject to blackout periods, and other restrictions may apply. Travel is subject to the terms and conditions set forth in this Contest and those set forth by the Sponsors’ airline carrier of choice, as set forth in the passenger ticket contract.
Winner and guests are responsible for obtaining any insurance (including but not limited to, any travel or health insurance).
The ARV of the trip package may vary depending on travel itinerary, and costs of air transportation at time of award. A winner will not receive the difference (if any) between actual and estimated retail value.
Winner and guests are responsible for obtaining identification documents necessary for travel. Winner may be required to present a credit card at time of hotel check-in. Winner and guests must travel on identical itinerary. The winner’s guests must be at least eighteen (18) years of age as of the date of departure or a child of the winner. If the winner does not designate guests in accordance with these Official Rules, no consideration will be provided to the winner for the value of the guest portion(s) of the prize package. No credit or cash will be given for any unused portion of a prize.
No refund or compensation will be paid in the event of the cancellation or delay of any flight, hotel accommodation, or park pass (collectively, the “Trip/Event”), or any portion thereof. Sponsors are not liable if the Trip/Event, or any portion of it, is cancelled or delayed, and no refund, compensation, or substitution will be provided to winner. Sponsors may, in their sole discretion, attempt to reschedule for a future trip/event. Trip/Event park passes are subject to certain terms and conditions as specified by issuer. The terms and conditions of the Trip/Event passes may govern if the Trip/Event is cancelled due to weather, an act of God, an act of terrorism, civil disturbance or any other reason. Sponsors are not responsible for, and will not replace, lost, mutilated, or stolen Trip/Event passes, tickets, vouchers, or certificates. Exact details, including seat locations (if any), shall be determined in the sole discretion of Sponsors.
Prizes must be used by redeemed within dates set forth by VISIT FLORIDA.
Winner Notification and Acceptance. Most Deserving Family Winner will be notified on or about July 16, 2012 at the telephone number provided on the entry form. Sponsors inability to reach the Grand Prize winner after a reasonable (as solely determined by the Sponsors) effort has been made, return of any prize notification as undeliverable and/or a winner's failure to timely respond to prize notification may result in that winner's disqualification, the forfeiture of his or her interest in all prizes, and the selection of a substitute winner from among the remaining eligible entries based upon the entry with the next highest score according to the Criteria or the next highest number of votes, as applicable.
A PARTICIPANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL SPONSOR HAS COMPLETED ITS VERIFICATION OF PARTICIPANT’S ELIGIBILITY
To claim prize, a winner must personally visit WSB-TV, 1601 West Peachtree Street, Atlanta, GA 30309 within thirty (30) business days after notification (office visits must be between the hours of 9 a.m. (E.S.T.) and 5 p.m. (E.S.T.) weekdays) and must present a valid photo identification. Winners may waive their right to receive prizes. Prizes are nonassignable and nontransferable. No substitutions allowed by winner. Prizes and individual components of prize packages are subject to availability and Sponsors reserve the right to substitute prizes of equal or greater value. Each winner is solely responsible for reporting and payment of any taxes on the prize and Sponsors will issue an IRS Form 1099 based on the prize value determined by Sponsors. Winner may be required to provide his/her valid Social Security Number to Sponsors for tax purposes and/or complete an IRS W-9 form in order to claim a prize.
Winners may be required to complete an affidavit of eligibility certifying that the entrant's submission is entrant's original work, that entrant owns right to the work, and that entrant has complied with the Official Rules of the Contest, and a liability and publicity release (except where prohibited by law), which must be returned within ten (10) days of date of personal delivery or date of postmark. Failure to sign and return the affidavit or release within ten (10) days, or to comply with any term or condition of these Official Rules, may result in a winner's disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to a substitute winner based upon the entry with the next highest score according to the Criteria or the next highest number of votes, as applicable.
Participation. By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsors and any Contest judges or administrators selected by Sponsors, which are final and binding in all respects. Sponsors reserve the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by Sponsors. In the event the Contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsors which corrupt or impair the administration, security, fairness or proper operation of the Contest, Sponsors reserve the right in its sole discretion to suspend, modify or terminate the Contest. Should the Contest be terminated prior to the stated expiration date, Sponsors reserve the right to award prizes based on the entries received before the termination date. Proof of sending or submission of an entry will not be deemed proof of receipt by Sponsors.
Authorization. BY ENTERING THE CONTEST, YOU REPRESENT AND WARRANT THAT (I) YOUR ENTRY IS ORIGINAL, WAS LEGALLY OBTAINED AND CREATED, AND DOES NOT INFRINGE THE INTELLECTUAL PROPERTY RIGHTS OR OTHER LEGAL, EQUITABLE, OR MORAL RIGHTS OF ANY THIRD PARTY; (II) YOUR ENTRY IS TRUTHFUL AND REFLECTS YOUR HONEST OPINIONS, BELIEFS, AND/OR PERSONAL EXPERIENCES; (III) THE ENTRY YOU ARE SUBMITTING HAS NOT PREVIOUSLY BEEN PUBLISHED OR ACCEPTED FOR PUBLICATION AND IS NOT CURRENTLY UNDER CONSIDERATION FOR PUBLICATION; AND (IV) YOU WILL NOT DISSEMINATE OR OTHERWISE SUBMIT YOUR ENTRY TO ANY OTHER ENTITY FOR PUBLICATION. ANY BREECH OF THE ABOVE LISTED REPRESENTATIONS AND WARRANTIES COULD, IN THE SPONSORS SOLE DISCRETION, RESULT IN TERMINATION OF ENTRY INTO THE CONTEST.
Publicity Release. BY ENTERING THE CONTEST, YOU AGREE THAT SPONSORS, COX MEDIA GROUP, LLC, COX ENTERPRISES, INC., AND THEIR RESPECTIVE SUBSIDIARIES, AFFILIATES, SUPPLIERS, DISTRIBUTORS, ADVERTISING/PROMOTION AGENCIES, AND PRIZE SUPPLIERS AND EACH SUCH COMPANY’S OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, AND SUCCESSORS AND ASSIGNS (COLLECTIVELY, THE “RELEASED PARTIES”) HAVE THE ABSOLUTE RIGHT AND PERMISSION TO PUBLISH YOUR ENTRY ON THEIR RESPECTIVE WEBSITES AND TO BROADCAST, PUBLISH, OR OTHERWISE USE YOUR ENTRY AND/OR YOUR NAME, BIOGRAPHICAL INFORMATION, AND LIKENESS IN CONNECTION WITH THE CONTEST OR FOR ANY COMMERCIAL, PUBLICITY, OR PROMOTIONAL PURPOSE WITHOUT LIMITATION, REVIEW OR APPROVAL, OR COMPENSATION TO YOU. BY ENTERING, YOU GRANT THE RELEASED PARTIES AN EXCLUSIVE, ROYALTY-FREE AND IRREVOCABLE LICENSE AND RIGHT (BUT NOT THE OBLIGATION) TO TELECAST, BROADCAST, COPY, EDIT, ADAPT, MODIFY, REPRODUCE, PUBLISH, CREATE DERIVATIVE WORKS OF, DISTRIBUTE, USE, OR OTHERWISE PUBLICLY DISPLAY ANY OR ALL OF YOUR ENTRIES, OR ANY PORTION THEREOF, IN ANY MANNER OR MEDIUM THROUGHOUT THE WORLD IN PERPETUITY, FOR COMMERCIAL, PUBLICITY, OR PROMOTIONAL PURPOSES, AND TO LICENSE OTHERS TO DO SO, WITHOUT LIMITATION, REVIEW OR APPROVAL, OR COMPENSATION TO YOU.
Indemnification. If either Sponsor’s use of your entry causes either or both Sponsors to be subject to a claim by any third party, you agree to indemnify and hold harmless the Released Parties, and all persons acting by, through, under or in concert with them, against any and all damages, costs, judgments and expenses (including reasonable attorney’s fees) which the Released Parties (or any one of them) may incur as a result of the use of your entry.
Release. BY PARTICIPATING IN THE CONTEST, EACH PARTICIPANT AGREES TO FULLY RELEASE, FOREVER DISCHARGE AND HOLD HARMLESS THE RELEASED PARTIES FROM AND AGAINST ANY CLAIMS, COSTS, LIABILITIES, LOSSES, INJURIES, AND DAMAGES ARISING OUT OF THE CONTEST, INCLUDING, BUT NOT LIMITED TO, ANY CLAIMS FOR PERSONAL INJURY, DEATH, OR DAMAGE TO OR LOSS OF PROPERTY, LOSS OF ENJOYMENT, OR ANY OTHER HARM WHATSOEVER ARISING OUT OF: (1) PARTICIPATION IN THE CONTEST; (2) THE QUALITY, RECEIPT, POSSESSION, USE, OR MISUSE OF ANY PRIZE; OR (3) ANY TRAVEL OR ACTIVITY THAT IS RELATED TO THE CONTEST OR ANY PRIZE.
Limitations of Liability. By PARTICIPATING IN the Contest, ENTRANTS acknowledge and agree that EVERYTHING REGARDING THIS CONTEST, INCLUDING THE WEB SITE AND THE prize(S), ARE provided “as is” and that RELEASES PARTIES make no representations or warranties OF ANY KIND, express or implied, about the Prize(S) and RELEASED PARTIES hereby DISCLAIM all such warranties, including, but not limited to, any implied warranties of merchantability or fitness for a particular purpose. (BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN IMPLIED WARRANTIES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH STATES, THE LIABILITY OF THE RELEASED PARTIES IS LIMITED TO THE FULLEST EXTENT PERMITTED BY SUCH STATE LAW.)
The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by ENTRANTS, printing OR PRODUCTION errors, or by any of the equipment or programming associated with or EMPLOYED in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the CONTEST, the processing of entries, or the notification of any winner; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from A ENTRANT’S participation in the Contest or receipt or use or misuse of any prize (INCLUDING, BUT NOT LIMITED TO, ANY PRIZE-RELATED TRAVEL).
Only the number of prizes stated in these Official Rules is available to be won in the Contest. In the event that production, technical, seeding, programming, or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsors reserve the right to award the prize based the finalist that received the highest number of votes.
Construction. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
Sponsors. The Montlick & Associates Deserving Military Family Contest is sponsored by WSB-TV and Montlick & Associates, Attorneys. The decisions of Sponsors and the Contest judges regarding the selection of winners and all other aspects of the Contest shall be final and binding in all respects. Sponsors will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Contest.
