Official Rules

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

1.Eligibility: WSB-TV and Attorney Ken Nugent “Nominate a Black Legend” (the “Contest”) is open to residents of the State of Georgia who are 18 years of age or older at the time of entry. Employees of Georgia Television Company d/b/a WSB-TV (“Sponsor” or “WSB-TV”), Attorney Ken Nugent or any of their respective parent or affiliated companies, or advertising or promotional agencies, and the immediate family members of, and any persons domiciled with, any such employees, are not eligible to participate in the Contest. For purposes of this Contest, the term “immediate family members” includes an entrant’s spouse, children, siblings, grandparents and grandchildren.

2.Details: WSB-TV and Attorney Ken Nugent are asking viewers to submit an essay of 200 words or less nominating a Black Legend in the community. Nominations should be based on an individual who is a resident of the State of Georgia (or recognized as a Georgian). Each nominee should be first in their field and must be living.

3.Submission of Essays: The Contest begins on February 1, 2012 at 9:00 am EST and continues through February 28, 2012 at 8:59am EST (the “Contest Period”). Essays must be 200 words or less and must describe in detail the accomplishments and reasons for nominating the person as a “Black Legend in the Community”

Essays may be submitted in one of the following two ways: 1.Internet: Submit your essay online by visiting wsbtv.com/contests and clicking on the linking for the “Nominate a Black Legend” Campaign. You will need to submit all required information, follow all posted instructions and submit an essay of 200 words or less. Entries are submitted for review in the contest by clicking the “submit” button. 2.Mail Entry: You can submit your essay by mail by typing or handwriting your essay, along with your name, mailing address, phone number, email address, and date of birth, on a postcard or piece of paper and mailing it to: WSB-TV/Nominate a Black Legend; 1601 West Peachtree Street; Atlanta, GA 30309. All entries must be legible and in English and received no later than March 15, 2012. Limit one entry per outer stamped envelope.

No more than one (1) entry per person is permitted. Multiple essays submitted by the same person will be disqualified. WSB-TV will not review, and will not be responsible for, incomplete, lost, late, postage-due, misdirected or illegible entries or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor. In the event of a dispute, all online entries will be deemed to have been submitted by the holder of the email account identified in the entry materials. For these purposes, an email account holder shall mean the natural person assigned to such email account by the Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with such email account. Any questions regarding the number of entries submitted or the holder of an email account shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Contest.

4.Station’s Rights: All submissions will become the property of WSB-TV and will not be returned. BY SUBMITTING AN ESSAY, YOU ACKNOWLEDGE AND AGREE THAT WSB-TV WILL HAVE THE RIGHT TO READ YOUR ESSAY ON THE AIR AND TO OTHERWISE PUBLISH, BROADCAST, REPRODUCE, OR USE YOUR ESSAY AND YOUR NAME IN ANY MANNER AND IN ANY MEDIA WHATSOEVER FOR PROMOTIONAL PURPOSES WITHOUT LIMITATION OR COMPENSATION TO YOU. With the exception of persons who have submitted letters on their own behalf, WSB-TV will not announce, publish, broadcast, or otherwise disclose the full names of any persons on whose behalf an essay is submitted, unless such persons have given WSB-TV permission to announce, publish, broadcast, or otherwise use or disclose their names.

5.Selection of Winner: A potential Winner will be selected if, and only if, a nominee meets all the criteria required. First in Field, Resident or known as a resident of Georgia, and living. Factors that the judges may consider in their decision include the persuasiveness of the essay and the factual information contained in the essay. Entries will be judged on a relative basis. Decisions regarding the determination of winners will be the sole responsibility of the WSB-TV Public Affairs department. A maximum of (1) potential winner will be chosen at the end of the campaign.

6.Prize Description: (1) potential winner will appear in a promotional vignette, produced by WSB-TV, portraying the life and accomplishments of the potential winner. Promotional vignettes will air on WSB-TV during Black History Month, February 2013.

7.Winner Notification and Prize Acceptance: Sponsor will attempt to potential winner by phone (correct daytime phone number, including area code, must be provided in all entry materials), during regular business hours, within seven (7) days of being selected as a potential winner. If a Selected potential winner submitted the winning entry on his or her own behalf, he or she will be declared a winner (subject to verification of eligibility). If a potential winner nominated someone other than him or herself to receive a prize, the person nominated will be declared a potential winner (subject to verification of eligibility) and will be asked to provide full contact information for the winner. If nominator is unable or unwilling to provide the necessary contact information for the person he or she nominated, the Selected Entrant and his or her nominee may be disqualified. Sponsor’s inability to reach a potential winner for any reason may, at the sole discretion of Sponsor, result in that winner’s disqualification and the forfeiture of that winner’s interest, and the Judges may select a substitute winning entry from among all remaining eligible entries. Winners may waive their right to receive a prize. Prizes and individual components of prize packages are nonassignable and nontransferable. No substitutions or transfers of prizes by winners are allowed. Prizes and individual components of prize packages are subject to availability and Sponsor reserves the right to substitute prizes of equal or greater value. Each winner will be required to complete an affidavit of eligibility and a liability and publicity release (except where prohibited by law). Failure to sign and return the affidavit and release, or to comply with any term or condition of these Official Rules, may, at the sole discretion of Sponsor, result in a winner’s disqualification and the forfeiture of his/her interest in the prize. Except where prohibited, acceptance of a prize constitutes each winner’s consent to the publication of his/her name, voice, likeness, image, biographical information, and hometown by Sponsor and Attorney Ken Nugent in any media (including broadcast, print, and other media) for any commercial or promotional purpose without limitation or further compensation.

Each winner also will be required to participate in an interview with WSB-TV about his or her participation in the Contest, and must permit WSB-TV to videotape a vignette for use as part of Black History Month Campaign in 2013. The interview, and the footage of the potential winner, may be aired by WSB-TV, in whole or in part, as part of its programming. If a potential winner is unable or unwilling to participate in the interview, he or she may be disqualified, in Sponsor’s discretion, and a substitute winner may be chosen from among all remaining eligible entries.

8.Participation: By participating, you agree to be bound by these Official Rules and the decisions of WSB-TV and the Judges. WSB-TV reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by WSB-TV. In the event the Contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of WSB-TV, which corrupts or impairs the administration, security, fairness or proper operation of the Contest, WSB-TV reserves the right in its sole discretion to suspend, modify or terminate the Contest. Should the Contest be terminated prior to the stated end date, WSB-TV reserves the right to fulfill winners based on essays received before the termination date.

9.Limitations of Liability: By participating in the Contest, you agree that (1) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or any benefits distributed in connection with the Contest, shall be resolved individually without resort to any form of class action, and you waive your right to a jury trial for such disputes, claims, and causes of action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys' fees; and (3) under no circumstances will any participant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.

10.Construction: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any participant or beneficiary and WSB-TV, shall be governed by, and construed in accordance with the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules or provisions (whether of Georgia, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Georgia. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained herein.

11.General Release: By participating in the Contest, you release WSB-TV, Cox Television, Inc., Attorney Ken Nugent, any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession or use of any benefit provided hereunder (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).

12.Sponsor / Winners List: The Contest is sponsored by WSB-TV. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Contest.
